TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of the website www.loperaindia.com, mobile applications, and online ordering services operated by L’Opéra (unit of French Bakery Private Limited) (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. DEFINITIONS

“Company”, “we”, “us”, “our” refers to French Bakery Private Limited (CIN No.U51220DL2008PTC184247) having registered office at Room No. C, B-93, Basement, Defence Colony, New Delhi-110024 and production facility at B-126, Sector-2, Noida, Gautam Budhha Nagar, U.P. -201301 at Band its affiliates.

“Platform” refers to the website www.loperaindia.com, mobile applications, and any

             online ordering services operated by the Company.

“User”, “you”, “your” refers to any person accessing or using the Platform.

2. ELIGIBILITY

By using the Platform, you confirm that:

You are legally capable of entering into binding contracts under applicable law.
All information provided by you is accurate and complete.

3. ACCOUNT RESPONSIBILITY

If you create an account on the Platform:

You are responsible for maintaining the confidentiality of login credentials.
You agree to accept responsibility for all activities under your account.
The Company shall not be liable for unauthorized use of your account.

4. USE OF THE PLATFORM

You agree to use the Platform only for lawful purposes.

You shall not:

Attempt unauthorized access to systems or data
Upload harmful software or malicious code
Interfere with platform functionality
Use the Platform for fraudulent or illegal activities

We reserve the right to suspend or terminate access for violations.

5. INTELLECTUAL PROPERTY RIGHTS

All content on the Platform including:

Logos
Product designs and images
Text, graphics, and branding elements

are owned by the Company or licensed partners and are protected by intellectual property laws.

No content may be copied, reproduced, or distributed without prior written consent.

6. PRODUCT INFORMATION & AVAILABILITY

All products are subject to availability.
Images are for representation purposes only.
Prices may change without prior notice.
The Company reserves the right to limit quantities or discontinue products.

7. FOOD SAFETY & ALLERGEN DISCLAIMER

Products may contain allergens such as nuts, dairy, gluten, or eggs.
Customers are responsible for checking ingredient information before consumption.
Products should be consumed within the recommended shelf life.
The Company is not liable for storage conditions after delivery.

 

8. ORDER ACCEPTANCE & CANCELLATION

An order is confirmed only after successful payment and order confirmation.

We reserve the right to:

Cancel orders due to operational constraints
Refuse suspected fraudulent transactions
Cancel orders due to pricing or technical errors

Refunds will be processed according to our Refund & Cancellation Policy.

9. PAYMENTS

We accept secure payment methods via authorized payment gateways.

The Company shall not be responsible for delays attributable to payment gateways or banks beyond its reasonable control.

10. DELIVERY & PICKUP

Delivery timelines are estimates and not guaranteed.
Customers must provide accurate delivery details.
Delays caused by weather, traffic, or third-party logistics are beyond our control.

Risk shall transfer upon successful delivery, subject to applicable consumer protection laws.

11. REFUND & RETURN POLICY

Due to the perishable nature of products:

Returns are generally not accepted.
Refunds, replacements, and cancellations are governed by our Refund & Cancellation Policy available on the Platform.

12. PROMOTIONS & OFFERS

Offers are subject to specific terms and validity periods.
The Company reserves the right to modify or withdraw promotions without notice.
Misuse of offers may result in order cancellation or account suspension.

13. USER CONDUCT

Users shall not:

Post defamatory or unlawful content
Violate intellectual property rights
Misuse customer service channels
Engage in abusive behavior

14. TERMINATION OF ACCESS

The Company reserves the right to:

Suspend accounts
Restrict access
Terminate services

at its sole discretion for violations of these Terms.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the Company shall not be liable for:

Indirect or consequential damages
Loss of profits or data
Service interruptions beyond reasonable control

Total liability shall not exceed the amount paid for the relevant order.

Nothing in these Terms shall limit liability for death, personal injury, product liability, or statutory consumer rights under applicable law.

16. INDEMNIFICATION

You agree to indemnify and hold harmless the Company from claims arising from:

Breach of these Terms
Misuse of the Platform
Violation of applicable laws

17. THIRD-PARTY LINKS

The Platform may contain links to third-party websites. We are not responsible for their content or policies.

18. PRIVACY

Use of the Platform is also governed by our Privacy Policy available on the Platform.

19. FORCE MAJEURE

The Company shall not be liable for delays or failure to perform obligations due to events beyond reasonable control, including:

Natural disasters
Government restrictions
Strikes
Pandemic events
Technical outages

20. MODIFICATION OF TERMS

We reserve the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.

21. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.

All disputes shall be subject to the exclusive jurisdiction of courts in New Delhi.
